Terms of Use
Mazā Māja B.V. (“BC.GAME”; “the Company”; “We”; “Us”; “Our”) is a private limited liability company registered in Curaçao, the Dutch Caribbean. BC.GAME® operates under license No. OGL/2023/118/0060, issued by the Curaçao Gaming Control Board (“GCB”).
By registering and clicking “I Agree” on www.bc.game (the Website), you as a user (“You”; “Your”; User; “Player”) agree to be bound by Our Terms of Service; Privacy Policy; Cookie Policy, and other policies or rules (“Terms”) applicable to the use of the Website. Accordingly, you hereby enter into a legally binding agreement with us, and your use of and access to our Website signifies that you have read, understood, and agreed to be bound by our Terms and Conditions.
Grant of License
1.1. Subject to the terms and conditions contained herein, BC.GAME grants the User a non-exclusive, personal, non-transferable right to use the service on their personal computer or other internet-connected device to access the games.
1.2. The service is not intended for use by (i) persons under the age of 18, (ii) persons under the legal age of majority in their jurisdiction, and (iii) persons accessing the service from jurisdictions where its use is illegal. BC.GAME cannot verify the legality of the service in each jurisdiction, and the user is responsible for ensuring the legality of their use of the service.
1.3. BC.GAME and its licensors are the sole owners of all rights to the Service, its code, structure, and organization, including copyrights, trade secrets, intellectual property, and other rights. You are not permitted, to the extent permitted by applicable laws: (a) to copy, distribute, publish, reverse engineer, decompile, disassemble, modify, or translate the Website; or (b) to use the Service in a manner prohibited by applicable laws or regulations (each of the foregoing being “Unauthorized Use”). BC.GAME reserves all rights, whether expressly or otherwise, not expressly granted to the User under this Agreement, and retains all rights, title, and interest in and to the Service. You agree that you will be solely liable for any damages, costs, or expenses arising out of or in connection with any Unauthorized Use by you. You must notify BC.GAME immediately of any Unauthorized Use that you become aware of and provide BC.GAME with reasonable assistance in any investigation it conducts in light of the information provided by you in this regard.
1.4. The term “BC.GAME,” its domain names, and any other trademarks or service marks used by BC.GAME as part of the Service (“Trademarks”) are the sole property of BC.GAME. Furthermore, all content on the site, including, but not limited to, images, graphics, photographs, animations, videos, music, audio, and text (“Site Content”) is the property of BC.GAME and is protected by copyright and/or other intellectual property rights or other rights. You hereby acknowledge that by using the service, you do not acquire any rights to the Site Content and/or the Trademarks or any part thereof. Under no circumstances are you permitted to use the Site Content and/or the Trademarks without the prior written consent of BC.GAME. Furthermore, you agree not to do anything that will or could potentially harm the rights of BC.GAME, including intellectual property rights.
No Warranties
2.1. BC.GAME disclaims all warranties, express or implied, in connection with the service, which is provided to you “as is,” and we provide you with no warranty or representation whatsoever regarding its quality, fitness for purpose, completeness, or accuracy.
2.2. Regardless of BC.GAME’s efforts, BC.GAME makes no warranty that the service will be uninterrupted, timely, or error-free, or that defects will be corrected.
3. Authority/Terms of Use. You agree to the game rules as described on the BC.GAME website. BC.GAME reserves the right to create, maintain, and terminate the Service. The decision of BC.GAME management regarding any use of the service or dispute resolution is final and not subject to appeal or challenge.
Your Obligations as a Player
4.1. You hereby represent and warrant that:
4.1.1. You are at least 18 years old or older, as determined by the legal age of majority in your jurisdiction of residence (e.g., Estonia – 21 years old), and under the laws applicable to you, you are legally permitted to participate in the games offered on the site.
4.1.2. You participate in the games for personal, non-professional purposes only and for recreational and entertainment purposes only.
4.1.3. You participate in the games on your own behalf and not on behalf of another person.
4.1.4. All information provided by you to BC.GAME during the term of the agreement is true, complete, correct, and you must notify BC.GAME immediately of any changes to such information.
4.1.5. You are solely responsible for reporting and accounting for any taxes applicable to you under relevant laws in connection with any winnings you receive from BC.GAME.
4.1.6. You understand that by participating in the games, you risk losing the virtual funds deposited into your member account.
4.1.7. You are not permitted to engage in any fraudulent, collusive, manipulative, or other illegal activity related to your or third-party participation in any of the games, and you are not permitted to use any software methods or techniques or hardware devices for your participation in any of the games. BC.GAME hereby reserves the right to void any bet in the event of such behavior.
4.1.8. You understand that virtual funds, such as Bitcoin, are not considered legal currency or a means of payment and are therefore considered virtual funds on the website and have no intrinsic value.
4.1.9. You understand that the value of Bitcoin can change dramatically depending on market value.
4.1.10. You are not permitted to use any payment methods that belong to a third party or another person.
4.2. You are not permitted to transfer, sell, and/or acquire user accounts.
4.3. The games on our site must be played in the same manner as games played in any other environment. This means that players must be polite to each other and avoid rude or obscene comments.
4.4. There may be circumstances where an offer is confirmed or a payment is made by our error. In all such situations, BC.GAME reserves the right to cancel all accepted bets containing such an error.
4.5. If a user discovers possible errors or incompleteness in the software, they undertake to refrain from exploiting them. Furthermore, you agree to report any errors or incomplete data to BC.GAME immediately. If you fail to comply with the obligations set out in this paragraph, BC.GAME is entitled to claim full compensation for all costs associated with the error or incompleteness, including any costs incurred in connection with the relevant error/incompleteness and your failure to report.
4.6. In the event that a game is started but fails due to a system failure, BC.GAME will refund the amount wagered in the bet to the User, including it in the User’s account, or, if the account no longer exists, by paying it to the User in an approved manner; and if the User had an accumulated credit at the time of the game failure, the cash value of the credit will be credited to the User’s account, or, if the account no longer exists, paid to the User in an approved manner.
4.7. BC.GAME reserves the right to refuse or limit bets. The User is not permitted to place a bet greater than their personal account. Winnings are credited to the user’s personal account.
4.8. BC.GAME reserves the right to withhold payments if there is suspicion or evidence of manipulation of the casino system. Any user or other person(s) who manipulated or attempted to manipulate the casino system will be subject to criminal charges. BC.GAME reserves the right to terminate and/or change any games or events offered on the site.
4.9. We reserve the right to request various verifications in cases where transactions appear suspicious or fraudulent.
4.10. BC.GAME reserves the right to declare a bet void in whole or in part if BC.GAME, in its sole discretion, believes that any of the following circumstances have occurred:
4.10.1. You or persons associated with you may directly or indirectly influence the outcome of an event to gain an unlawful advantage.
4.10.2. You and/or persons directly or indirectly associated with you circumvent the rules of BC.GAME
4.10.3. The outcome of an event was directly or indirectly affected by criminal activity.
4.10.4. Bets that would otherwise not have been accepted were accepted during periods when the website experienced technical problems.
4.10.5. Due to an error, such as a typographical error, writing error, force majeure, or any other reason, bets were offered, placed, and/or accepted due to this error.
4.10.6. If a player’s deposit fee is too low and is marked as “insufficient relay fee” on the blockchain or a similar site, BC.GAME reserves the right to confiscate winnings if BC.GAME, in its sole discretion, considers the transaction and player’s behavior to be fraudulent.
4.11. You will immediately inform BC.GAME if you enter into a self-exclusion agreement with any gambling service provider.
Prohibited Use
5.1. PERSONAL USE. The service is intended solely for your personal use. You are permitted to place bets for personal entertainment purposes only and are not permitted to create multiple accounts, including for the purpose of collusion and/or abuse of the services.
5.2. JURISDICTIONS. Persons residing or located in Aruba, Bonaire, Curaçao, France, the Netherlands, Saba, Statia, St. Maarten, and the United States (“Prohibited Jurisdictions”) must not use the service. To be clear, these restrictions on participating in real money games apply equally to residents and citizens of other countries in the prohibited jurisdictions. Any attempt to circumvent these restrictions, including manipulation of information used by BC.GAME to determine your location, or providing false or misleading information about your location or residence, is a breach of this agreement.
Know Your Customer (“KYC”)
6. BC.GAME reserves the right at any time to request any KYC documents necessary to verify a user’s identity and location. The service and payments may be restricted until your identity has been sufficiently verified.
Breach
7.1. Without prejudice to any other rights, if you breach any provision of this Agreement, in whole or in part, BC.GAME reserves the right to take such action as it deems appropriate, including terminating this Agreement or any other agreement with you and/or taking legal action against you.
7.2. You agree to fully indemnify, defend, and hold harmless BC.GAME and its shareholders, directors, agents, and employees from and against all claims, demands, liabilities, damages, losses, expenses, including legal fees, arising from your breach of this Agreement, your violation of any law or third party rights, or your use of the service.
Limitations and Liability
8.1. Under no circumstances, including negligence, shall BC.GAME be liable for any direct, indirect, special, incidental, or consequential damages (including loss of business profits, business interruption, or loss of business information) arising out of the use or misuse of the service, even if BC.GAME has been previously advised of the possibility of such damages.
8.2. This agreement does not exclude or limit BC.GAME’s liability for death or personal injury caused by its negligence.
Dispute
If you wish to file a complaint, please contact BC.GAME customer support by writing to [email protected]. If the dispute is not resolved to your satisfaction, you can seek solutions in the jurisdiction governed by the laws indicated below.
Amendment
BC.GAME reserves the right to update or modify this Agreement or any part thereof at any time, as well as to change the Service without prior notice. You will be bound by such amendments as soon as they are published. Therefore, we recommend that you periodically review the terms of this agreement. Continued use of the service constitutes your acceptance of any changes.
Governing Law
This agreement and any matters relating thereto shall be governed by the laws of Curaçao. You irrevocably agree that the exclusive jurisdiction over any claim, dispute, or controversy relating to this Agreement and any matters arising therefrom shall be with the courts of Curaçao. You irrevocably waive any right to object to proceedings in such courts, to claim that the case has been brought in an inconvenient forum, or to challenge the jurisdiction of such courts. This paragraph does not limit BC.GAME’s right to take proceedings against you in any other competent jurisdiction, nor does it preclude concurrent proceedings in more than one jurisdiction, as permitted by the laws of those jurisdictions. If any provision of this Agreement becomes or is held to be illegal, invalid, or unenforceable in any jurisdiction, this shall not affect the validity or enforceability of any other provision of this Agreement in that jurisdiction or the validity or enforceability of that or any other provision of this Agreement in any other jurisdiction.
Assignment of Rights
BC.GAME reserves the right to assign this agreement in whole or in part to any party at any time without notice. You may not assign any of your rights or obligations under this Agreement.
ADVANCE PLAY
If BC.GAME becomes aware that a user has accepted a bonus or promotion with the intention of obtaining a guaranteed profit by using methods that unfairly ensure the withdrawal of the bonus, BC.GAME will immediately void the winnings and close the account, reserving the right to suspend further withdrawal transactions. Examples of advance play include delaying the end of a game round until wagering requirements are met, or making new deposits while free spins or bonus features are available. Placing equal, zero, or low-margin bets or hedging bets is considered irregular play for the purpose of meeting bonus wagering requirements. If violations are detected during the game, BC.GAME reserves the right to suspend payouts and confiscate all winnings.
Terms of Use
Definitions: BC.GAME is referred to as “we” or “us.” The player is referred to as “you” or “Player.” “Website” means BC.GAME through desktop, mobile, or other platforms used by the Player.
